Vistale — Terms of Service

These terms are an agreement between you and Xin Song, an individual developer ("we"). By creating an account or using cloud features you accept them. Local mode without an account is covered by sections 5, 8, 9 and 10 only.

1. The service

Vistale lets you photograph a place, keep the story, and connect with people who photographed the same spot. Matching is automatic and approximate. We do not guarantee a match, an accurate place name, or that another user is who they say they are.

Members of our team also take part in views under their own accounts and names: they share photos taken where they really stood, and write, reply and feel the same like anyone else. A photo a team member took on the spot is matched and counts among the people who have been to a view, like anyone's. A team member who joins a view only to talk (to welcome people or answer a question) is not counted.

2. Accounts

You must be at least 13 years old, or the minimum age in your region. One account per person. Keep your device secure; you are responsible for activity under your account. You can delete your account at any time in Settings.

3. Your content

You keep every right to your photos and words. You give us a worldwide, non-exclusive, royalty-free license to store, process (including computing image vectors), display and transmit them, only as needed to run the service and only within the visibility you chose. The license ends when you delete the content, except for backup copies kept for up to 14 days and for content others have already legitimately received (for example a reply that quotes you).

You confirm that you have the rights to what you post and that it does not violate anyone's privacy, including people who appear in your photos where their consent is legally required.

4. Visibility and the core rule

Each memory is Only me or shared with People at this view, and a shared photo can also be shown in Discover. People who have not been to a spot see only photos and place names; stories, comments and questions open only after they match the same spot. We enforce this on our server, but you decide what to share: do not post anything you would not want a stranger who stood in the same spot to read.

5. Rules

Do not: post illegal content, harassment, hate speech, sexual content involving minors, or nudity; share someone else's private information; impersonate people; spam or advertise; scrape, reverse engineer or overload the service; use the app to stalk or track anyone; upload photos you do not have the right to share.

Shared content is checked before others see it: by automated systems first, and by a person for anything they are unsure about. We may remove content, restrict features or terminate accounts that break these rules, and report illegal content to the authorities.

6. Questions and meeting people

Questions are between users. We do not vet anyone. Meet in public places, tell someone you trust where you are going, and never send money. The app is not an emergency service.

7. Moderation, reports and blocks

Use Report to flag content and Block to stop seeing someone. We aim to act on reports within 24 hours. You can appeal a decision once in the app, or by email.

8. What we do not promise

The service is provided "as is". Capture details and match results are best-effort metadata, not proof of where or when something happened. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us (currently nothing). Nothing here limits liability that cannot be limited by law.

9. Ending the agreement

You can stop at any time by deleting your account or the app. We may suspend or end the service, with notice where reasonable, if you break these terms or if we stop operating; where possible you will be able to export your data first.

10. Apple

The app is distributed through Apple's App Store. Apple is not responsible for the app or its content and has no obligation to provide support. Apple is a third-party beneficiary of these terms and may enforce them against you.

11. Changes, law and contact

We notify you in the app before material changes take effect. These terms are governed by the laws of the People's Republic of China, excluding its conflict-of-law rules; disputes go to the competent court where the operator resides, without prejudice to mandatory consumer rights in your country.
